1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the services provided by Compensa, accessible via our website at getcompensa.com (the “Website”) and any associated tools or applications (collectively, the “Service”). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Definitions
  • “We/Us/Our” refers to Compensa LLC and its affiliates.

  • “Customer/You” refers to any individual or entity engaging Compensa to enforce compensation or refund claims.

  • “Claim” refers to any right to monetary compensation or reimbursement against an airline or other service provider arising from delays, cancellations, denied boarding, lost baggage, unused services, or similar disruptions.

  • “Assignment” means a written or electronic agreement by which you transfer your Claim to Compensa for the purpose of pursuing it in our name.

  • “Authorisation” means a written or electronic power of attorney authorizing Compensa to pursue the Claim in your name and on your behalf.

3. Use of Our Service

3.1. Eligibility. You must be at least 18 years old and legally capable of entering into binding agreements. You represent that you own the Claim or are authorized to assign or authorize it on behalf of other passengers.

3.2. Nature of Our Services. Compensa assists Customers in enforcing their rights to compensation or refunds from airlines and other service providers. Our services may include:

  • Assessing your Claim;

  • Preparing and submitting the Claim;

  • Communicating with airlines, travel agencies, hotels, tour operators and other parties;

  • Negotiating settlements or enforcing payment; and

  • Engaging lawyers or collection agencies if needed.

3.3. No Legal Advice. Compensa is not a law firm and does not provide legal advice or act as your attorney. We may retain attorneys or contract lawyers to pursue Claims, but any legal services are provided by those attorneys independently of Compensa.

4. Your Engagement

4.1. Order Process. By submitting your Claim via our intake form or Typeform, you make a binding offer to engage Compensa on a success‑fee basis. We accept your offer by confirming via email, by electronic signature, or by starting enforcement of the Claim.

4.2. Assignment or Authorisation. To pursue your Claim, you must either:

  • Assign the Claim to Compensa, transferring ownership of the Claim on trust to us; or

  • Authorize Compensa to enforce the Claim in your name and on your behalf.

We will specify in our confirmation which method applies. You agree to provide all documents, information, and signatures needed for us to pursue the Claim.

4.3. Exclusivity. From the time you engage us until termination in accordance with these Terms, you must not pursue the same Claim yourself or through another service. You agree to forward all communications from the airline or service provider to Compensa promptly and not to accept any settlement directly without our knowledge. If you receive compensation directly after engaging us, our success‑based fee remains payable.

4.4. Cooperation. You undertake to provide accurate and complete information and to respond to requests in a timely manner. Misleading or incomplete information may result in termination of our engagement.

5. Fees and Payment

5.1. No Win, No Fee. Compensa operates on a 25 % contingency fee (plus any applicable taxes) of the total compensation or refund we recover for you. You owe nothing if no compensation is recovered.

5.2. Commission Structure.

  • Successful Claim: Our fee is calculated on the gross amount recovered (including flight vouchers, travel credits, or other in‑kind compensation). If compensation is paid in a non‑cash form, we will invoice you the equivalent cash commission based on the value of that compensation.

  • Partial Recovery: If only part of the Claim is recovered, the fee is calculated on the recovered portion.

  • Lawyer Engagement: If we need to involve external attorneys, court proceedings, or debt collection, we may charge a higher commission if specified in the engagement confirmation. However, you will never be charged more than the amount recovered.

5.3. Payment Handling. Compensation may be paid:

  • Directly to Compensa, in which case we deduct our fee and remit the balance to you; or

  • Directly to you, in which case you agree to pay our fee within 14 days of receipt.

5.4. Taxes and Interest. Our fee is exclusive of VAT or other applicable taxes. Any statutory interest recovered from the airline belongs entirely to Compensa to offset costs and attorney fees.

6. Cancellation and Termination

6.1. Withdrawal by Customer. You may cancel within 14 days of engaging Compensa without charge, provided we have not yet submitted the Claim or incurred costs. Once we have filed the Claim or engaged attorneys, our success‑based fee remains due if compensation is later obtained.

6.2. Premature Termination. If you terminate our engagement after we have begun enforcing the Claim and subsequently recover compensation (either directly from the airline or via another service), you are still liable for our 25 % commission on the recovered amount.

6.3. Termination by Compensa. We may terminate the engagement if:

  • You provide false or misleading information;

  • You fail to cooperate;

  • We determine the Claim lacks merit; or

  • Enforcing the Claim is uneconomical (e.g., the airline is insolvent).

7. Privacy and Cookies

7.1. Data Collection. We collect personal data (e.g., flight details, contact information) necessary to pursue your Claim and operate our business. By using our Service, you consent to our Privacy Policy.

8. Intellectual Property

10. Liability and Disclaimer

10.1. No Guarantee. We do not guarantee success in enforcing your Claim. We provide our Service on a best‑efforts basis and are not liable for unsuccessful enforcement or delays in the process.

10.2. Limitation of Liability. To the maximum extent permitted by law, Compensa excludes all liability for indirect, special, incidental, or consequential damages arising from your use of the Service. We do not exclude liability for death, personal injury, fraud, or other liabilities that cannot be excluded under applicable law.

11. Miscellaneous

11.1. Modification. We may update these Terms from time to time. The latest version will always be posted on our Website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11.2. Severability. If any provision of these Terms is held invalid, the remaining provisions remain in full force.

11.3. Governing Law. These Terms and any disputes arising out of or relating to them are governed by the laws of the jurisdiction in which Compensa is registered, without regard to conflict of law principles.
